who's is liable, if anyone, do i have a case?

I had sustained an injury while shopping in a large store. As I was leaving this store with my purchase, my left ankle was ran over by a thief that was trying to flee the store with a shopping cart full of stolen tv's and other store goods.This man had been in the store stealing twice this day but was not caught the first time. He was however apprehended shortly after he injured me in his second theft attempt. I did press charges and he was convicted for assault, but he has no money and is a repeat offender. The entire incident is on video tape and so is the first time he was in that day, and successfully got away with stolen goods.The store was watching him the 2nd time he was in the store, but they did nothing until he left the store and ran over me. I have suffered serious damages to my ankle and foot, and am still in a boot cast after 6 months. I had an attorney that took the case right away 1 wk after the incident, then just dropped me as a client a week ago stating that there is no way they could prove liability to the store. Do you have any advice for me with the possibility of seeking legal advice? Do I even have a small chance at a case or proving the store liable?
