Hi my name is Kim. A drunk driver hit a tree in our yard that fell on both of our cars and then hit another tree in our yard(which stopped him ). Our one car was totalled and we are getting a check for $6072. And the other car is in the shop for repairs of around $7000. The insurance company of the drunk driver is paying for both cars and the damage to my yard of $1100. And they are supplying(paying for) the rental car. My dilemma is that I lost work due to this accident and am only getting $6000 for the second car and only have one car for my husband I to get back and forth to work. My other car will be returned within a month when it is repaired. Can I take the driver to court for loss of work and more money for a second car? No one was injured thankfully. I am not a rich person and he has inconvenienced us for over 2 weeks now. I also want to know if there is a way to check and see if we can see if he is still driving since the car he was driving WAS his father's and he still has his personal car. Thanks for any help in this matter. Also we are located in NJ.

This is beyond confusing. Is "the second car" the same car as the car that was totalled? If so, you said you're getting a check for $6,072, which you should be able to use to buy a replacement. Right?
Or is "the second car" the same car as "the other car" that is "in the shop" for repairs that are being paid for by the drunk driver's insurer and for which the drunk driver's insurer is paying for a rental car?
